RETURNS AND REFUNDS POLICY

1. Change of Mind Returns

Change of mind returns are only available for standard, pre-manufactured products and do not apply to custom-made, made-to-order, modified or specially ordered products.

 

A change of mind return may be accepted at Walnut Construction’s discretion, provided all the following conditions are met:

 

  1. The return request is made within 30 days from the date of collection or delivery.

  2. Where the product was supplied with packaging, the original packaging must remain unopened and in its original condition.

  3. The product must be unused and uninstalled.

  4. The product must be in its original condition, free from any damage, including (but not limited to) dents, scratches, marks, paint damage, modifications or any other signs of use or handling.

  5. If the product has already been delivered, the customer must either:

  • return the product to Walnut Construction’s nominated warehouse at their own expense; or

  • request Walnut Construction to arrange collection, in which case collection and freight charges will apply.

  1. An administration and restocking fee equal to 25% of the purchase price of the returned product will be deducted from any refund.

  2. Any original delivery charges, express freight charges, installation costs or other service fees are non-refundable.

  3. Custom-made, made-to-order, modified or specially ordered products are not eligible for return, exchange or refund due to a change of mind under any circumstances.

 

2. Faulty, Damaged or Defective Products

  1. Customers are requested to inspect all products as soon as reasonably possible after collection or delivery.

  2. Any visible transport damage, missing items, incorrect products or other apparent issues should be reported to Walnut Construction within 24 hours of collection or delivery. Prompt notification allows us to investigate and resolve the issue as efficiently as possible.

  3. If a product is found to have a fault, defect or failure, the available remedy will depend on whether the issue is considered a minor failure or a major failure under the Australian Consumer Law.

Minor Failure

A minor failure is a defect that can be rectified within a reasonable time and does not substantially affect the normal use, safety or purpose of the product.

For a minor failure, Walnut Construction may, at its discretion:

  • repair the product; or

  • replace the product with an equivalent product.

Major Failure

A major failure includes circumstances where the product would not have been purchased had the customer known of the defect, is substantially unfit for its intended purpose, is significantly different from its description or sample, or is unsafe.

Where a major failure exists, the customer may choose either:

  • a replacement product; or

  • a refund,

 

3. Refund Process

  1. To request a return, replacement or refund, the customer must complete Walnut Construction’s Returns Request Form, available at:

  1. Once the completed form has been received and the return has been assessed and approved in accordance with this Returns & Refunds Policy and the Australian Consumer Law (where applicable), any approved refund will be processed within five (5) business days.

  2. Refunds will be issued using the original payment method, or where this is not reasonably practicable, by another payment method agreed between Walnut Construction and the customer.

  3. Any applicable deductions, including administration or restocking fees for approved Change of Mind returns, will be applied before the refund is processed.

DELIVERY AND COLLECTION POLICY

1. Delivery Scheduling

  1. Where delivery has been requested, Walnut Construction will schedule delivery based on the next available delivery time slot and will notify the customer accordingly.

  2. For eligible online orders, delivery will generally be completed within three (3) business days, unless otherwise advised.

  3. All delivery dates and times are estimates only and may vary depending on operational requirementsCustomers will generally be provided with an estimated four (4) hour delivery window.
     

2. Delivery Timeframes

  1. The customer must ensure that an authorised person is available at the delivery address to receive the goods during the nominated delivery period.

  2. While Walnut Construction will use reasonable efforts to deliver within the estimated timeframe, delivery may be delayed due to circumstances beyond our reasonable control, including but not limited to heavy traffic, road closures, severe weather, supplier delays, vehicle breakdowns, accidents or other events affecting the safe transportation of goods.

  3. Where possible, Walnut Construction will notify the customer of any significant delay.
     

3. Site Access Requirements

  1. The customer is responsible for ensuring that the delivery location is safe and accessible.

  2. Prior to delivery, the customer must notify Walnut Construction of any site conditions or access restrictions that may affect delivery, including but not limited to:

  • restricted vehicle access;

  • narrow streets or driveways;

  • low overhead clearances;

  • soft or unstable ground;

  • steep driveways;

  • weight restrictions;

  • any other condition that may prevent safe access by the delivery vehicle.
     

4. Unloading Responsibilities

  1. Unless otherwise agreed in writing, the customer is responsible for unloading goods from the delivery vehicle.

  2. Where goods cannot reasonably be unloaded manually due to their size or weight, the customer must provide suitable unloading equipment, including an appropriately rated forklift, together with a competent operator.
     

5. Delivery Address

  1. The customer is responsible for providing a complete and accurate delivery address together with all information reasonably required to complete delivery.

  2. An authorised person must be available to accept delivery.

  3. Any additional costs arising from incorrect or incomplete delivery information may be charged to the customer.
     

6. Risk and Responsibility

  1. For warehouse collections, risk in the goods passes to the customer immediately upon collection from Walnut Construction’s warehouse.

  2. For deliveries arranged by Walnut Construction, risk passes to the customer once unloading has commenced at the nominated delivery address.
     

7. Failed Deliveries

A delivery may be deemed unsuccessful where, including but not limited to:

  • no authorised person is available to receive the goods;

  • suitable unloading equipment or personnel are unavailable;

  • the delivery area is not ready to receive the goods;

  • access to the site is unsafe or unsuitable;

  • previously undisclosed site restrictions prevent safe delivery; or

  • delivery cannot be completed due to inaccurate delivery information provided by the customer.

Where a delivery cannot be completed for any of the above reasons, Walnut Construction reserves the right to return the goods to its warehouse. Any additional delivery, transport, storage or handling costs incurred will be payable by the customer.

 

8. Partial Deliveries

  1. Where reasonably necessary due to production scheduling, stock availability, transport capacity or other operational requirements, Walnut Construction may deliver an order in multiple shipments.

  2. A partial delivery does not constitute a breach of contract and does not entitle the customer to cancel the order, refuse delivery of the remaining goods or claim compensation solely because delivery was completed in more than one shipment.
     

9. Customer Collections, Vehicle Requirements and Safe Loading

  1. For all customer collections, the customer is solely responsible for providing a vehicle or trailer that is suitable for the size, weight and nature of the goods being collected.

  2. Walnut Construction reserves the right to refuse to load any vehicle or trailer where, in its reasonable opinion, the vehicle, trailer or proposed method of transport is unsuitable, unsafe, overloaded, inadequately equipped or would otherwise result in a breach of applicable transport or road safety laws.

  3. The customer is solely responsible for ensuring that all goods are properly restrained and secured using appropriate load restraint equipment before leaving Walnut Construction’s premises.

  4. Walnut Construction will not comply with any customer request that would require or encourage an unsafe loading practice or a breach of any applicable transport, road safety or load restraint legislation.

  5. Any assistance provided by Walnut Construction employees during loading is provided as a courtesy only and does not constitute acceptance or approval of the suitability of the customer’s vehicle, trailer, load restraint system or transportation method.

  6. For customer collections, all risk in the goods passes to the customer immediately upon completion of loading and collection from Walnut Construction’s premises.

  7. Walnut Construction reserves the right to stop or suspend the loading process at any time where it reasonably considers that continuing the loading operation may create a safety risk or result in non-compliance with applicable laws or regulations.

  8. The customer is responsible for ensuring that the loaded vehicle complies with all applicable Victorian and Australian road transport requirements, including (without limitation):

  • the combined width of the vehicle and its load must not exceed 2.5 metres;

  • the load must not project more than 150 millimetres beyond either side of the vehicle body unless otherwise permitted by law;

  • where the load projects more than 1.2 metres beyond the rear of the vehicle, an appropriate warning flag (minimum 300 mm × 300 mm) must be displayed during daylight hours, and appropriate warning lights must be used where legally required;

  • the load must not obscure the driver’s field of vision, vehicle lights, reflectors, registration plates or any legally required safety equipment; and

  • the load must be safely secured and transported in accordance with all applicable load restraint and road safety requirements.

Failure to comply with these requirements is the sole responsibility of the customer or the driver of the collecting vehicle.

10. Payment

For customer collections, payment must be completed prior to collection. For deliveries arranged by Walnut Construction, payment must be received in full before the delivery vehicle departs from Walnut Construction’s premises.

​INSTALLATION POLICY

This Installation Policy applies exclusively to projects where installation services are carried out by Walnut Construction. It does not apply to supply-only orders.

The Installation Policy is divided into three sections: Before Installation, During Installation, and After Installation. Customers are requested to carefully review and comply with the requirements set out in each section below.

1. Before Installation :

  1. Customers are required to completely clear the area where the fence will be installed, including a width of 600 mm, from plants, tree branches, debris, or any similar items before the installation begins. Please note that if the site is not prepared by the customer before installation, an additional fee of $1,000 will be added to the invoice for one day of the installation team's wage, and a new installation date will be scheduled by the company.

  2. All items listed on the invoice are produced and installed strictly according to the measurements specified on the invoice. By placing an order, the customer acknowledges that they have thoroughly reviewed the invoice and are confident about the specifications of the ordered products (materials, dimensions, color, etc.). It should be noted that any changes to the invoice requested by the customer will require new agreement with the company and may incur additional costs.

  3. All customers ordering motors for their gates are required to provide power point within a maximum distance of 2 meters from the gate. Otherwise, the customer must inform the sales representative at the time of ordering to supply a 24V motor, and wiring costs will be added. Additionally, any request to change the motor type from 24V to 240V or vice versa on the day of installation will not be accepted.

  4. Prior to any installation involving excavation or ground penetration, the customer must arrange for a qualified utility/service locator to identify and mark all underground services. If this has not been completed before installation, the customer will be responsible for any resulting delays, additional costs or damage to underground services, and Walnut Construction reserves the right to postpone or refuse the installation where it is unsafe to proceed.

  5. The exact installation date will be communicated to the customer at least 24 hours in advance. However, if weather conditions delay the work, the company will arrange a new installation date in coordination with the customer.

  6. The installation timeline may vary from 30 to 45 days from the order date (deposit payment), depending on weather conditions and the company's schedule. This timeline may extend by up to 15 additional days in case of product complexity or if the customer needs to approve the design.
     

2. During Installation:

  1. Customers who have pets (especially dogs) are responsible for restraining and keeping their pets away from the installation area during the entire installation period. Otherwise, the installation team has the right to leave the site, and the customer will be charged a penalty of $5,000 for non-compliance with the pet containment agreement.

  2. Providing restroom facilities for the installation team during the installation process is the responsibility of the customer.

  3. The customer is required to be present at the installation site for the first 3 hours of the installation day.
     

3. After Installation:

  1. Customers are required to settle their invoice in full with the company within 48 hours of completing the installation. Please note that failure to make timely payments will result in a late fee of 1% per day added to the outstanding amount.
    For example: If $5,000 remains unpaid on the customer’s invoice and they settle 10 days after the 48-hour deadline, an additional $500 penalty will be added to the remaining $5,000 on the invoice.
